What the market wants – developing licences based on use

CAL works closely with all of its corporate licensees to ensure that licence agreements remain dynamic and tailored to the needs of businesses, associations and non-profit organisations. After a review of feedback from current licensees, CAL has expanded the range of permissions relating to works represented by the New Media Licence Schemes.
 
CAL always attempts to approach licensing arrangements in ways that ensure  any changes to how licensees can use copyright works does not conflict with the current or developing business models of rightsholders.
 
The redeveloped New Media Licence Schemes will allow licensees to use the works CAL represents in the following ways:
  • print, photocopy, scan, or email content internally;
  • include content in a slide or other presentation directly to an audience physically present;
  • supply content electronically to external advisers for legal proceedings;
  • supply content electronically as part of filing or obtaining regulatory approval; and
  • for health and pharmaceutical companies:
    - supply content electronically to health professionals legitimately requesting medical information in relation to the use of the licensee’s products; and
    - supply electronic copies to other organisations in relation to the use or support of any of the licensee’s products, where the receiving organisation also holds a current CAL licence.
If you are a CAL member and you have already authorised CAL to include your works in its New Media Licence Schemes, these will be automatically included in this new licence offering. You can of course notify CAL at any time to withdraw from this or any other voluntary licence scheme by contacting CAL’s Membership team on 1800 066 844 or emailing memberservices@copyright.com.au.
 
CAL has also been approached by commercial colleges seeking authorisation to provide paper and electronic copies of works to their students in off-shore campuses – in countries where there is no collecting society with which to negotiate a licence. That use is not covered by the Australian statutory scheme for educational use, as the usage will take place outside Australia. Only those members who have authorised CAL to include their works in CAL’s New Media Licence Schemes will participate in this extended licensing option.
 
If you are a CAL member who has chosen to participate in the statutory schemes only, you will not receive payment if your works are used in any of the situations mentioned above.
