Our input on the ‘exposure draft’ of potential copyright changes

As reported in February’s Creative Licence (here), the government is seeking feedback on an ‘exposure draft’ (ED) of potential copyright changes. The ED is just for consultation, and does not represent the government’s final position on legislation for introduction into Parliament.

There are many aspects of the drafting in the ED that do not align with the Minister’s policy intent that any changes:

  • maintain the incentives and protections for content creators; and
  • are reasonable.

We have given the Department a detailed submission on problematic drafting in the ED. The Department will publish submissions here. It has received more than 100 submissions.

It is unlikely that any legislation would be introduced into Parliament before the next Federal election.

Separately to the consultation on the ED, the Department is looking at the impacts on the creative industries of any copyright changes that would reduce payments from the education sector. Please contact us if you would like further information about this.
