Senate Committee recommends Copyright Amendment Bill be passed

On 19 December 2025, the Senate Legal and Constitutional Affairs Legislation Committee recommended that the Copyright Amendment Bill 2025 be passed. The Committee’s report is here.

If passed, the Bill will:

  • introduce a scheme that limits remedies for infringement against a person who was unable to identify and locate a rightsholder after a ‘diligent search’ (orphan works scheme)
  • clarify that section 28 of the Copyright Act (that applies to a performance in class) covers:
    • a class that is delivered online (remote learning)
    • parents and other people providing assistance to students in class
    • a person other than a teacher (such as a member of the local community) providing educational instruction

We supported passage of the Bill, as did other organisations including Australian Society of Authors, Australian Publishers Association and National Association for the Visual Arts.
