Copyright Agency welcomes passage of Copyright Amendment Bill

The Copyright Amendment Bill 2026 was passed on 31 March.

The Bill resulted from longstanding consultations, and the Government’s commitment to reaching consensus positions with affected stakeholders.

We commend the Government on the consultation process, and to its ongoing support for Australia’s creative industries.

The Bill primarily relates to:

  • ‘orphan works’: a scheme that limits remedies for infringement against a person who was unable to identify and locate a rightsholder after a ‘diligent search’
  • performances in class: clarification that section 28 of the Copyright Act covers:
    • a class that is delivered online (remote learning)
    • parents and other people providing assistance to students in class
    • a person other than a teacher (such as a member of the local community) providing educational instruction
